There is an important deadline coming up for New Yorkers: March 31, 2022.
*Deadline extended two months: Applications must now be submitted by 3/31/2022 to avoid the 2 1/2 year look-back period and penalties for Community Medicaid.
On April 1st, the commencement of look-back penalties for Community Medicaid begins. Putting in your application well in advance of the deadline, and having it done by an experienced Medicaid Planning attorney is your key to approval and not paying out-of-pocket for these services. Essentially, free home care services!
When the 'no look-back' rules end April 1st,2022, your assets will be left exposed and make the Community Medicaid process more complicated and costly.
2 1/2 year look-back
Right now there is no look-back period. Under the new regulation a look-back on transfers of assets for applications for community-based services goes back 2 1/2 years.
Medicaid will refuse to cover the cost of care and also assess a penalty period based on the value of transfers made out of the applicant’s or their spouse’s name during that 30-month period.
Which services does the look-back apply to?
Currently, New York law specifies home health care services, private duty nursing services, personal care services, and some assisted living program services.
